Master Terms & Conditions of Service

Effective date:11/6/26
Business: Jusby the Clown and Comedy Consultant

1. Scope and acceptance

These Terms & Conditions (“Terms”) govern services provided by Jusby the Clown (“Jusby,” “we,” or “us”) to individuals, organizations, and other customers (“Client” or “you”).

They cover singing telegrams, private parties, festivals, roaming entertainment, haunted attractions, weddings, ceremonies, corporate events, workshops, individual mentorship, group instruction, Laughter Yoga, Brick Oracle readings, fortune tellers, custom creative work, and merchandise.

The general terms apply to every engagement. Service-specific provisions apply only to the services purchased.

A written proposal, invoice, or booking confirmation establishes the particular scope, date, duration, location, price, and deliverables. Any separately negotiated written agreement takes precedence where it expressly differs from these Terms.

The Client accepts these Terms through an affirmative acknowledgment during booking or by signing an agreement incorporating them.

2. Booking confirmation

An inquiry or estimate does not reserve a date.

A booking is confirmed when the parties have agreed in writing on the essential details, the Client has accepted these Terms, and any required deposit has been received.

Availability is not guaranteed before confirmation.

The Client must provide accurate event details, including venue, schedule, audience, access instructions, and relevant restrictions. Material changes may require an updated quote.

3. Deposits, fees, and payment

Private performances and custom bookings require a deposit equal to 50% of the agreed service fee, unless a different arrangement is expressly accepted in writing.

This includes private celebrations, singing telegrams, weddings, and engagements requiring customized preparation.

Standard merchandise purchases, group-class registrations, and mentorship sessions may use different payment arrangements stated at checkout or in the booking confirmation.

The remaining balance for a performance is due before the performance begins.

For workshops, mentorship, commissioned work, and organizational engagements, the payment schedule will be specified in writing before confirmation.

Additional services, overtime, travel, lodging, materials, shipping, or special requirements may incur additional charges, disclosed and agreed upon in advance.

Tips are voluntary and do not replace contracted payment.

4. Cancellation policy

The following tiered policy applies to confirmed private performances and custom engagements unless a service-specific written agreement provides otherwise.

14 or more calendar days before the engagement

The Client may cancel and receive a refund of payments received, less documented, agreed, nonrecoverable expenses and the reasonable value of custom work already completed.

7–13 calendar days before the engagement

Jusby may retain up to the 50% booking deposit to compensate for reserved time, preparation, and lost booking opportunities, subject to applicable law.

Fewer than 7 calendar days before the engagement

The Client may be responsible for up to the full agreed service fee, reduced by costs avoided, replacement-booking revenue reasonably attributable to the released time, and any other reductions required by law.

Cancellation charges are intended to reasonably compensate for actual or anticipated loss, not to impose a penalty.

Any nonrefundable deposit or cancellation charge must be disclosed and agreed upon before booking.

Rescheduling

Requests to reschedule are subject to availability. With at least 14 days’ notice, one rescheduling request may be accommodated without an additional rescheduling fee, provided the service and scope remain substantially unchanged.

A request made with less notice may be treated as a cancellation and new booking unless otherwise agreed.

Cancellation by Jusby

If Jusby cannot provide the agreed service, the Client will be offered an available replacement date or a refund for services not delivered.

A substitute performer may be proposed but will not be assigned without the Client’s consent.

5. Delays, changes, and overtime

The Client is responsible for ensuring that the venue, audience, and necessary event arrangements are ready at the agreed starting time.

A delay caused by the Client or venue does not automatically extend the scheduled ending time.

Extensions are subject to availability and an additional fee agreed upon before the extension begins.

Jusby may make reasonable adjustments to the performance format when necessary to accommodate conditions, audience needs, or safety requirements.

Substantial changes to the agreed scope require mutual approval.

6. Travel and venue conditions

The Client must provide accurate directions, access instructions, parking information, and a reliable on-site contact.

Travel and related expenses will be identified before booking.

The Client is responsible for venue permissions and permits unless expressly assigned to Jusby.

Performance areas must provide reasonably safe access, sufficient space, and suitable environmental conditions.

Outdoor engagements require an appropriate contingency plan when weather could prevent safe performance.

Jusby may pause, modify, relocate, or discontinue an activity if conditions present an unreasonable safety risk.

7. Respect, inclusion, and consent

Jusby the Clown provides inclusive, consent-forward entertainment.

Harassment, discrimination, intimidation, threats, and abusive conduct toward performers or participants are not acceptable.

Audience participation is voluntary. No participant is required to accept physical contact, perform publicly, reveal personal information, or continue an unwanted interaction.

Jusby will respect refusals and seek appropriate consent before physical contact.

Clients and participants must likewise respect the performer’s boundaries.

Humor may be mischievous, surprising, satirical, or absurd, but unwilling participants will not be deliberately humiliated.

Jusby may end an interaction or engagement when serious misconduct or unsafe behavior makes continuation unreasonable.

8. Children and vulnerable participants

Jusby provides entertainment and instruction, not childcare or custodial supervision.

The Client must ensure appropriate adult supervision of children.

A parent, guardian, or authorized responsible adult must approve individual instruction involving minors.

Children may decline activities without penalty or embarrassment.

Reasonable accessibility and participation accommodations may be requested in advance.

9. Props, activities, and special effects

Services may involve balloons, bubbles, small objects, physical movement, music, lighting, theatrical effects, or other props.

Participants must follow reasonable safety instructions.

Small objects and balloon fragments may present choking hazards. Materials will be selected and distributed with appropriate regard for age and safety.

Fire, flash, smoke, lasers, and comparable effects require advance approval and compliance with applicable laws and venue rules.

Jusby may omit an effect that cannot be performed safely or legally.

Physical activities are voluntary. Participants should work within their abilities and stop if they experience discomfort.

10. Photography, video, and promotional consent

Personal photographs and brief recordings of public-facing entertainment are generally permitted when they do not interfere with the performance or violate another person’s privacy.

Commercial filming, broadcasting, or advertising use requires advance written permission unless expressly included in the agreement.

Promotional use by Jusby requires separate, affirmative opt-in consent.

Acceptance of these Terms does not authorize Jusby to publish identifiable photographs, recordings, testimonials, or personal information about the Client or participants.

Declining promotional consent will not affect the service or price.

Consent must specify the permitted material and uses. Permission involving minors must be obtained from an authorized parent or guardian where required.

Private mentorship sessions and workshops may be recorded only with the knowledge and agreement of those involved.

Any withdrawal of promotional consent will apply to future uses to the extent reasonably practicable and legally required; previously distributed materials may not always be recoverable.

11. Intellectual property

Jusby retains ownership of original routines, teaching materials, scripts, character concepts, artwork, designs, and other independently created intellectual property unless otherwise agreed in writing.

Payment for a performance or lesson does not automatically transfer copyright or exclusive rights.

Clients receive the rights expressly identified in their agreement.

Students retain ownership of their own original characters, discoveries, and creative work.

Collaborative projects intended for publication or commercial exploitation should have ownership and usage rights established separately.

12. Accessibility

Jusby welcomes advance requests for reasonable accommodations relating to mobility, communication, sensory needs, and participation.

Alternatives will be explored in good faith when an activity or venue presents limitations.

The Client remains responsible for accessibility obligations applicable to the venue or event under the Client’s control.

13. Nature of services and results

Jusby will provide services with reasonable care, preparation, and professional judgment.

Creative and educational outcomes are subjective. Audience response, artistic breakthroughs, employment, bookings, and income cannot be guaranteed.

Brick Oracle readings, fortune tellers, and related experiences are offered for entertainment and creative reflection, not as substitutes for professional medical, legal, psychological, or financial advice.

14. Liability and insurance

Each party remains responsible for its acts and omissions as provided by applicable law.

The Client is responsible for conditions, personnel, and equipment under the Client’s control. Jusby is responsible for exercising reasonable care in providing the agreed services.
